Hearing On The Merger Of BSP MLAs In Rajasthan High Court

Hearing on the merger of BSP disciplines in Rajasthan High Court, Sibal said petition not hearable. The petition against the merger of BSP MLAs into Congress is being heard in the High Court. On behalf of the speaker, senior advocate Kapil Sibal said that the petition is not hearable.

The Rajasthan High Court is hearing a petition against the merger of six MLAs of the Bahujan Samaj Party (BSP) into the political struggle in Rajasthan.

This petition has been filed by BJP leader Madan Dilawar. During the hearing, senior advocate Kapil Sibal, on behalf of the Rajasthan speaker, said that the petition is not hearable.

Earlier during the hearing on Wednesday, the court issued notice to Assembly Speaker Dr. C.P. Joshi and sought a reply. The notice was also issued to the MLAs who merged the BSP with the Congress from the High Court, but all are in Jaisalmer for the last five days.

In such a situation, he could not get notice. The reply has been sought from these MLAs till August 11. A bench of Chief Justice Inderjit Mahanti and Justice Prakash Gupta heard the case on Wednesday. As soon as the hearing started, Dilawar and BSP demanded to declare the merger of MLAs invalid.

On Wednesday, BSP General Secretary Satish Chandra Mishra said in the High Court that as long as the matter is in the court, the BSP MLAs should not be allowed to cast any vote in the floor test. He also said that the merger of MLAs with Congress is unconstitutional.

What is the matter

Significantly, in September last year, BJP MLA Madan Dilawar filed a petition before the speaker for canceling the assembly membership of BSP MLAs Rajendra Gudha, Jogendra Singh Awana, Sandeep Kumar, Wajib Ali, Lakhan Singh, and Deepchand.

But the Speaker canceled his petition. After this, the Speaker also approved the merger of all the MLAs in Congress in March this year. Madan Dilawar reached the High Court on this. The BSP also became a party with him.
