SC Seeks Affidavit From Uddhav And Shinde Faction

SC seeks affidavit from Uddhav and Shinde faction, next hearing on August 1: Maharashtra Political Crisis.

A bench of Chief Justice NV Ramana heard the petitions of the Uddhav Thackeray-led camp and the Eknath Shinde camp on the political crisis in Maharashtra.

After hearing the arguments of all the parties, the Supreme Court said that if necessary, some issues can be referred to a larger bench, that is, a Constitutional Bench.

Its next hearing will be on August 1. The Supreme Court has asked all the parties to file their replies by Tuesday.

SC seeks affidavit from Uddhav and Shinde faction: The argument of the Shinde faction’s lawyer Harish Salve.

Harish Salve, appearing for the Eknath Shinde faction, said that democracy within Shiv Sena was strangled through disqualification proceedings.

If a large number of people in the party think that another person should lead, then what is wrong with it. If you gain enough strength within the party.

He stays in the party and questions the leader. If you tell him that you will defeat him in the House, it is not defection.

Defection is when you leave the party and join hands with others. Not when you’re at the party.

The Supreme Court has never interfered in the working of any political party. Anti-defection law does not apply automatically. There is a petition for this too.

If a member goes to the governor and says that the opposition should form the government, then it is called quitting the party himself.

If the chief minister resigns and another government takes oath, it is not a defection.

Should such a person who is not able to get the support of 20 MLAs remains the Chief Minister, are we in the world of dreams? Raising a voice against the chief is not a disqualification.

SC seeks affidavit from Uddhav and Shinde faction: Uddhav faction’s lawyer Kapil Sibal’s argument.

Uddhav faction’s lawyer Kapil Sibal said that the MLAs who parted ways from Shiv Sena are disqualified. He did not even merge with any party.

If the petition of the Shinde faction is heard, then every elected government can be toppled. This would put democracy in danger. The issue of a political party is a question in itself.

When disqualified members elect a person, then this election is not right.

What will happen to people’s decisions? You can put a stay on the disqualification of the Speaker, but how can the proceedings be stopped.

Now Shinde faction is saying that they will go to the Election Commission. This is a mockery of the law. This incompetent government should not last even a day.

Uddhav faction’s lawyer Abhishek Manu Singhvi’s argument.

Abhishek Manu Singhvi, the second lawyer of the Uddhav faction, said that a day before leaving for Guwahati, the Shinde faction sent a letter to the then deputy speaker in an unofficial mail, demanding his removal.

I do not consider this to be a record, because no MLA had come before the Deputy Speaker, then how did this happen? You cannot stop the speaker or call a floor test.

This absolute majority is unrealistic. If we 4 people are disqualified here then ineligible people can’t take part in the floor test. Supreme Court has the power to change whatever has happened in the past.

Cabinet expansion stalled due to the decision.

Deputy CM Devendra Fadnavis took oath along with Maharashtra CM Eknath Shinde. Since his swearing-in, the program of cabinet expansion has been stalled.

There is speculation about the expansion of the cabinet only after the decision on the membership of the MLAs.

If the decision on the membership of MLAs comes in the hearing today, then the date of expansion of the cabinet can be announced soon.

The special thing is that after winning the trust vote on July 4, the Shinde faction issued notices to 14 MLAs of the Uddhav camp.

The action was taken against the MLAs for violating the whip issued by Gogavale.

The special thing is that both the factions are accusing each other of not accepting the party whip. As a result, there has been a demand for disqualification from both sides.

12 MPs came in support of Shinde.

Maharashtra CM Eknath Shinde had paraded 12 MPs in front of the Lok Sabha speaker on Tuesday, staking a claim on Shiv Sena. Shinde claims that he has the support of 18 out of 19 Shiv Sena MPs.

Speaker Om Birla also recognized rebel group leader Eknath Shinde’s supporter MP Rahul Shewale as the leader of Shiv Sena in the Lok Sabha.

Apart from this, the appointment of Shiv Sena MP Bhavna Gawli as Chief Whip was also accepted.
