The court said that the parents can be illegitimate, but the child born to them cannot because the child has no role in its birth.

A division bench of Justice BV Nagarathna and Justice H. Sanjeev Kumar made the above observation while setting aside the order of the single bench.

Santosh, who had applied for a compassionate job in the Government Bangalore Electricity Supply Company (BESCOM) after the death of his father in 2014.

His father was working in the company as Lineman Grade-II.

Since the petitioner was born out of second marriage against the father’s first marriage, the company rejected his application, saying it was against its policy.

Thereafter, the petitioner appealed to the High Court, which was rejected by the single bench of the court.

No child can come into the world without a father and a mother.

Setting aside the order of the single bench, the division bench said that no child can come into the world without a father and a mother.

Therefore, the law must recognize the fact that parents can be illegitimate, but children cannot. It is the job of Parliament to bring uniformity in the law regarding the legality of children.

Thus, it is for Parliament to determine how protection can be provided to children born outside a valid marriage.

He was denied a job on compassionate grounds.

The court, while allowing the appeal filed by the petitioner, asked the defense to take appropriate steps.

In this case, the Karnataka Power Transmission Corporation Limited (KPTCL) was denied eligibility for appointment on compassionate grounds on the basis of the 2011 circular.

The circular said that a clause of the 2011 KPTCL circular states that the second wife or her children are not eligible for appointment on compassionate grounds, in so far as it relates to the children of the second wife if the marriage takes place during the first marriage. happened.

Father died seven years ago.

Petitioner K. Santosh’s father worked as a lineman in the Karnataka Power Transmission Corporation Limited (KPTCL). He died in the year 2014 while on the job.

Thereafter the petitioner requested a compassionate job in the company. On this, the company rejected their request citing the above circular. Thereafter he approached the court.

Action to be taken within two months.

After hearing the matter, the court asked Karnataka Power Transmission Corporation Limited to take appropriate steps within two months.

The court has directed the defense to consider the application made by the petitioner in accordance with the law.

The court said the order would be considered within a period of two months from the date of receipt of the certified copy, as the employee had died about seven years back.
