CBI independent to take action against CM Mamta Banerjee for ignoring the law: SC.

Referring to the unprecedented incident of Bengal Chief Minister Mamata Banerjee staging a sit-in at the CBI office with supporters,.

The Supreme Court on Tuesday asked the CBI to protest against the house arrest of TMC leaders for taking action against the chief minister and the law minister if they break the law.

CBI independent to take action: The accused are free but cannot bear the brunt of their acts.

The court said that the dharna etc. of the leaders cannot be appreciated. Nor does the court support the acts of the Chief Minister and the Law Minister.

The bail of the accused and the acts of the leaders are both different cases. They cannot be seen together.

The bench said, we do not support the acts of CM and Law Minister Realizing the intent of the bench, which was unwilling to interfere with the house arrest (detention) order of TMC leaders.

The CBI withdrew its petition to the Supreme Court. The order of the High Court of House arrest was challenged in the Supreme Court.

The CBI had laid the groundwork for the state government’s sit-in with the supporters of the Chief Minister Mamata Banerjee on the arrest of the leaders and the unprecedented situation of the CBI officials not coming out of the office.

At the same time, till the order  was issued, State Law Minister was staying in the court also presented as a means of pressure.

A bench of Justices Vineet Saran and BR Gavai allowed CBI to withdraw the petition, stating that he was not passing any order on the merit of the case.

The case is being heard by a five-judge bench of the High Court. The petitioner CBI and other parties can place all the arguments before the High Court.

CBI withdraws plea challenging TMC leaders’ house arrest order. Earlier, Solicitor General Tushar Mehta, appearing for CBI, said that the matter is very serious.

The Supreme Court should take cognizance of this. It is to be seen under what circumstances the House Arrest Order was passed.

Mehta said that the case is under investigation. CBI has arrested four people. After the arrest, a mob of people surrounded the CBI office.

The Chief Minister also came there and he started the same sit-in. The mob pelted stones at the CBI office, due to which officials could not get out of the office.

CBI public prosecutors could not reach the court to oppose the bail and they argued through mobile phones.

On the other hand the Law Minister of the state remained in court till the order was passed. The Chief Minister and the Law Minister pressurized the CBI.

The Chief Minister was in support of the arrested people. Under these circumstances, the top court should take note of the court hearing.

Mehta said that the case should be shifted outside the state. But the bench did not agree with his pleas.

The bench said, the case is being heard by a constitution bench of five judges of the High Court. Transferring the case out of state would discourage the High Court.

The bench said that there are two issues here. One is the acts of politicians and the other the freedom of the individual.

CBI independent to take action: The bail of the accused is being considered here. The court cannot see both issues merged. You can take action against the Chief Minister, Law Minister for what they had done.

But the accused cannot bear the brunt of their work. On the plea of ​​pressure on the court, the bench said that we do not think that our courts can come under any pressure.

Justice Gavai also narrated an old memoir of his own in this regard. Without notice in the case, senior advocate Vikas Singh was present on behalf of the Bengal government and opposed the CBI’s plea.
