Allahabad HC dismisses habeas corpus petition of deceased girl’s relatives: Hathras Case. Even though the Dalit girl, who lost her life after the attack on 14 December in Boolgarhi village of Hathras, relatives of the deceased girl went to the Allahabad High Court for additional protection, the court rejected their plea.

The Allahabad HC dismissed the habeas corpus petition filed in the Boolgarhi case of Hathras on behalf of the deceased girl’s family. It was said in the petition that the family members have been imprisoned by the administration and they are not being allowed to meet anyone.

The court said that the Supreme Court and the High Court are hearing this matter. The petitioners have been given protection on the court’s order. There is no justification for such interference. The order was passed by a division bench of Justice Pritikar Diwakar and Justice Prakash Padiya on the petition of the victim’s father and six others.

The habeas corpus petition has been filed by Surendra Kumar, national general secretary of All India Valmiki Mahapanchayat of Sonepat (Haryana). Through the WhatsApp message, the victim’s family has made Mahmud Pracha and others of the Supreme Court a lawyer.

Additional Advocate General Manish Goyal objected to the maintainability of the petition and said that the PIL in the Supreme Court is under consideration. The victim’s family and witnesses have been given protection on the court’s order.

The family has not authorized anyone to file a petition by giving advocates. The message is a forward message. Who wants to appoint whom is not clear. The family has been given personal guards.

CCTV cameras are installed at home so that no anti-social elements can enter the house. Family members never told the administration that they wanted to go out. No one has been stopped them as they are free.

Seeks reply from state government on PIL

The Allahabad High Court has sought a response from the state government on the PIL filed in connection with the Hathras incident. The court has asked the state government to file an affidavit on the issues raised in the petition.

The petition has been filed by advocate Manjusha Bhartiya. A bench of Justice MN Bhandari and Justice Piyush Aggarwal, hearing the case, has directed the petition to be submitted on 19 October.

The petition has demanded a CBI inquiry into the incident, compensation, and protection to the victim’s family. At the same time, it was said on behalf of the state government that most of the issues raised in the petition have been heard in the Supreme Court.

The state government has filed its reply there. The case is being heard in the Supreme Court, so the petition should be rejected, but the court did not accept this demand.
