They can now build their dream home in centrally-ruled Jammu and Kashmir whenever they want, as the central government has amended the laws relating to the Land Ownership Act in Jammu and Kashmir.
Any citizen of the country can now buy land for their houses, shops, and businesses in Jammu and Kashmir. There will be no restriction on him. A new notification has been issued by the Ministry of Home Affairs on Tuesday.
However, the ban on farming land will continue. According to Jammu and Kashmir Lieutenant Governor Manoj Sinha, we want the outside industries to be set up in Jammu and Kashmir, hence the need to invest in industrial land.
But the cultivated land will remain only for the people of the state. The Central Government’s decision came about four days before the first anniversary of the reorganization of Jammu and Kashmir State as a Union Territory under the Jammu and Kashmir Reorganization Act.
Know- What was the rule before: It is worth mentioning that before five August 2019, the state of Jammu and Kashmir had its own constitutional system.
In that system, only permanent citizens of Jammu and Kashmir, who had permanent citizenship certificate of the state called State subject, could buy land there.
No citizen of any other part of the country could buy land for his house, shop, business, or farming in Jammu and Kashmir. He could acquire or rent land on a lease basis only after completing certain legal formalities.
But now people from outside can also buy land and start work there.
The Union Home Ministry has taken this decision under the Jammu and Kashmir Reorganization Act, under which any Indian can now buy land for a factory, house, or shop in Jammu and Kashmir. For this, proof of being a local resident will not be required.
Necessary to be a local resident for the purchase of agricultural land: Despite the expiry of the constitution and law of Jammu and Kashmir, the process of amendment was not finalized on the necessary reforms in the law relating to the Land Ownership Act.
However, last evening, the Central Home Secretary issued the necessary notification in this regard. According to this notification, any citizen of any part of the country can now buy land for any difficult house-building or business.
For this, he does not have to complete the formalities of any domicile or state subject. Domicile would be needed only for the purchase of agricultural land.
Jammu and Kashmir was exempted from Article 370 last year
Significantly, Jammu and Kashmir have been exempted from Article 370 only last year, after which Jammu and Kashmir became a Union Territory on 31 October 2019. Now, on the completion of one year of being a union territory, the law of the land has been changed.
Opposition to the change in the law of the land started: After this order of the central government, Kashmir-centric parties, including the National Conference and the People’s Democratic Party, have started opposing it.
Former Chief Minister and National Conference President Omar Abdullah and former Chief Minister and PDP President Mehbooba Mufti termed the order as unconstitutional, saying that they will not accept this law at any cost.
Those associated with the industry welcomed: On the other hand, people associated with the industry are calling this new law a lifelong. Industrialists say that the prospects of industry in Jammu and Kashmir will increase after the land law is implemented.
Major industrialists based in other states of the country will be inspired to set up industries in Jammu and Kashmir, which will remove unemployment here.
