West Bengal Government Gets A Setback From The Supreme Court

West Bengal government gets a setback from the Supreme Court, dismisses the petition against giving protection to Suvendu Adhikari from arrest.

The Mamata Banerjee government of West Bengal has once again got a big setback from the Supreme Court. The Supreme Court on Monday dismissed a petition by the West Bengal government.

The petition challenged the order of a single bench of the Calcutta High Court which had granted protection to BJP leader Suvendu Adhikari from any coercive action in the criminal cases registered against him by the state police.

A bench of Justices DY Chandrachud and AS Bopanna told the counsel appearing for the West Bengal government that they have already dealt with a similar case.

The Supreme Court said that both the parties will act on the basis of the order passed by it on December 13, 2021.

Therefore, it is not necessary or proper to entertain the present special leave petition.

The state government’s plea challenged the Calcutta High Court’s decision to grant protection to Suvendu Adhikari from arrest in the cases registered against him.

After the top court refused to consider the state government’s plea from Trinamool Congress (TMC) government on 13 December 2021.

BJP leader Suvendu Adhikari was charged with a felony, unlawful gathering, and violation of COVID-19 guidelines, among other charges.

The state government says that the complaints against Suvendu Adhikari cannot be termed as malicious.

The top court had on December 13 refused to interfere with the High Court order restraining the police from taking any coercive action against the officer.

Suvendu Adhikari had moved the High Court alleging that the Mamata Banerjee-led West Bengal government was misusing the police machinery against him.

West Bengal government had registered six FIRs against him in four different police stations.

The official had said that the West Bengal government has been continuously harassing him since he changed political allegiance in December 2020.

In September 2021, while granting interim protection to the officer, the High Court had said that the West Bengal government was trying to harass the BJP leader.
