Uddhav Thackeray faction reaches Supreme Court against the order of the Election Commission, demanding a stay on the proceedings: Maharashtra Politics.

The matter of the ongoing internal fight in Shiv Sena has once again reached the Supreme Court.

This time the Uddhav Thackeray Shiv Sena faction has filed a petition in the Supreme Court regarding the order of the Election Commission.

Seeking to stay the proceedings of the Election Commission on the petition of the Eknath Shinde faction for recognition as the real Shiv Sena.

The Uddhav faction says that the Election Commission cannot determine who is the real Shiv Sena till the disqualification of the rebel MLAs is decided.

Challenged the Election Commission’s order to file the Shinde faction and the Uddhav faction along with the Shiv Sena’s claim document by August 8.

The Uddhav faction is terming the order of the Election Commission as unconstitutional and a hasty decision. The petition has been filed by Shiv Sena general secretary of Thackeray Group, Subhash Desai.

It has been said in the petition that the Shinde faction is trying to increase the numbers illegally and create an artificial majority in the organization. The issue is already pending before the Supreme Court.

If the Election Commission proceeds with the matter, it will cause irreparable damage, which amounts to interference in judicial proceedings, to investigate the matter which is sub-judice before the court.

Thus it amounts to contempt of court.

The Election Commission has sought details from both groups.

The Election Commission has also asked both the factions to give in writing the reasons for the ongoing protests within the party.

Earlier, in a letter to the Election Commission, state CM Eknath Shinde and his fellow MLAs claimed to have 40 Shiv Sena MLAs and 12 MPs with them.

Eknath Shinde has staked a claim on the party.

Eknath Shinde wrote to the Election Commission that the Shiv Sena’s national executive appointed by Uddhav Thackeray has been dissolved and a new executive has been formed.
