The SC Dismissed The Petition Of The Chhattisgarh Government

The SC dismissed the petition of the Chhattisgarh government, and the High Court’s order granting bail to Gurjinder Pal Singh was challenged.

TSC on Tuesday challenged the High Court order granting bail to suspend Additional Director General of Police Gurjinder Pal Singh under the Prevention of Corruption Act on charges of disproportionate assets.

The petition of the Chhattisgarh government was dismissed. The Supreme Court says that the state’s petition is completely baseless.

The SC dismissed the petition: Court said – there is no merit in the appeal.

A bench of Justices BR Gavai and Justice Hima Kohli dismissed the Chhattisgarh government’s plea for the cancellation of bail of one Gurjinder Pal Singh and said that his appeal has no merit.

“This present application is nothing but a grossly unfair practice by the state,” the bench said.

While considering bail the High Court has no business dealing with the position of the applicant and it is about individual rights.

In disproportionate assets cases, most are documentary evidence, which leaves no chance of tampering. The petition has no merit and is dismissed.

Allegation of tampering with evidence.

Senior advocate Mukul Rohatgi, representing the state government, argued that Singh had tampered with the evidence, which was ignored by the high court.

The High Court had on May 12 granted bail to Singh in the corruption case.

On May 4, the Supreme Court had refused interim bail to Singh and asked the High Court to dispose of his bail matter, which is pending before it.

The disparity between expenditure and income.

The state government had stated that there is a disparity and discrepancy between the assets, expenditure, and income of Gurjinder Pal Singh from the information received by the EOW/ACB.

As a result of which an FIR was registered on July 29, 2021.

Gurjinder Pal Singh, a 1994 batch IPS officer, served as the Additional Director General of ACB and EOW before being transferred to the State Police Academy in June 2021.
