Tamil Nadu Elections 2021: HC Upholds Postal Ballot Notification

Tamil Nadu Elections 2021: High Court upholds postal ballot notification.

The Madras High Court on Wednesday refused to interfere with the Election Commission notification in which Tamil Nadu Assembly Elections have provided the option of voting to people over 80 years of age, differently-abled, and Covid-19 affected through postal ballot.

A bench of Chief Justice Sandip Banerjee and Justice Senthilkumar Ramamurthy expressed their reluctance to file a PIL filed by DMK.

Tamil Nadu Elections 2021: The petitioner argued that Section 60 (c) of the Representation of the People Act is against the basic structure of the Constitution as it breaches the secrecy of voting.

Secrecy in voting is the basic foundation of free and fair elections and it establishes parliamentary democracy. This section gives the executive the right to nominate someone for grant of postal ballot rights.

Therefore, such unbridled power is contradictory and arbitrary which should be rejected.

The Assembly has a total of 234 seats in Tamil Nadu, with All India Anna Dravida Munnetra Kazhagam (AIADMK) having 136 MLAs.

Apart from this, the Dravida Munnetra Kazhagam (DMK) has 89. At the same time, Congress has seven seats, Indian Muslim League has five seats. Tamil Nadu will go to the polls on April 6. While the vote will be counted on May 2.
