Notice of breach of privilege against TMC MP Mahua Moitra over remarks regarding former Chief Justice.

A notice of breach of privilege has been given in the Lok Sabha against Mahua Moitra, a TMC MP, for comments against a former Supreme Court Chief Justice.

Bharatiya Janata Party (BJP) MP Nishikant Dubey and PP Chaudhary served notice against All India Trinamool Congress (AITC) MP Mahua Moitra for a motion for breach of privilege in the Lok Sabha.

This notice has been given to him for his adverse statement regarding the conduct of the former Chief Justice of India.

In a letter to the Speaker of the House, the two BJP leaders said that on 8 February 2021, AITC party Member of Parliament Mahua Moitra made an adverse statement in his speech on the motion of thanks on the President’s address.

He made remarks in the House regarding the conduct of the then Chief Justice of India, Shri Ranjan Gogoi in the discharge of duties.

The letter said that Article 121 of the Constitution of India specifically provided that there would be no discussion in Parliament regarding the conduct of a judge of the Supreme Court or any High Court.

The letter states that the conduct of the judges of the Supreme Court and the High Court while discharging their duties under the Article 121 mandate is discussed in Parliament.

The above speech is now available on Mahua Moitra’s media platforms YouTube, Twitter handles, and other social media platforms.

The letter further stated that, therefore, the privilege of this House by the Member of Parliament related to the statement made on the Table of the House relating to the conduct of the then Chief Justice of India while performing his duties and uploading the same on social media platforms Abuses occur.

The letter stated that Moitra said that his statement should not be terminated and that this privilege was violated intentionally as it was being telecasted live on Lok Sabha TV.
