The Kerala government has received a major setback from the High Court in the gold smuggling case.
The Kerala High Court on Friday dismissed two FIRs lodged against the Enforcement Directorate officials by the state police, shocking the state government of Pinarayi Vijayan.
The state police had filed an FIR accusing the Enforcement Directorate (ED) officials of pressurizing the main accused to make a statement against Chief Minister Pinarayi Vijayan in the gold smuggling case.
The court dismissed the FIR, on the Kerala government’s complaints of evidence tampering by Enforcement Directorate officials.
KHC said that the police should approach the special PMLA court which considers cases related to money transactions in the gold smuggling case.
The court directed the investigating officers to give all the information in a closed envelope to the PMLA court.
Justice VG Arun gave the order during the hearing on the two applications filed by P. Radhakrishnan, Deputy Director, ED Kochi Zone. In the petitions, the two FIRs lodged by the crime branch were challenged.
The crime branch had filed an FIR based on the alleged audio clip of Swapna Suresh, accused in the gold smuggling case, in which the accused was being pressured to drag the chief minister in the case.
A similar allegation was made in a letter allegedly written by Sandeep Nair, Swapna’s co-accused in the smuggling case.
Swapna is a former employee of the UAE consulate here and is the main accused in the case of smuggling 30 kilograms of gold worth Rs 14.82 crore in the consignment of diplomats.
In addition to the ED, the Customs Department and the National Investigation Agency are also investigating.
The case of gold smuggling was revealed in July last year.
This case of gold smuggling came to light in July last year. A large quantity of gold was recovered by customs officials from Thiruvananthapuram International Airport.
The gold was packed in bags for the UAE consulate. Airport sources said Sona was kept in a bag full of equipment used in the toilets.
A former employee of the United Arab Emirates (UAE) consulate has been detained on charges of smuggling. The former employee has been taken to Kochi for investigation after being detained.
When the accused came to know that his belongings would be examined, he also threatened the customs officials.
Meanwhile, a report by Jai Hind television channel claimed that a top official of the Chief Minister’s office allegedly tried to help a former employee of the UAE consulate at the airport.
