Will Rahul Gandhi Become PM? Bombay HC rejects PIL against Rahul Gandhi over Savarkar remarks, saying, “Are you sure he’ll be PM?” Full details on the court’s sharp response.
The Bombay High Court on Tuesday (July 15) flatly refused to hear a public interest litigation (PIL). In this petition, it was demanded to stop Congress leader Rahul Gandhi from ignoring the contribution of freedom fighter Vinayak Damodar Savarkar.
The court said that the Supreme Court has already rejected a similar petition, which was filed by petitioner Pankaj Phadnis. Pankaj Phadnis is the co-founder of Abhinav Bharat Congress. He had accused Rahul Gandhi of violating constitutional duties by commenting against Savarkar.
Phadnis said in his petition that Rahul Gandhi made an objectionable statement about Savarkar in a speech given in London. It is alleged that in this statement, Rahul Gandhi allegedly said, “Savarkar considered Muslims as traitors.” The petitioner had demanded from the court that Rahul Gandhi be directed to understand Savarkar’s contribution and avoid such comments.
A division bench of Bombay High Court Chief Justice Alok Aradhe and Justice Sandeep Marne said that the Supreme Court had rejected a similar petition of Phadnis on May 27. The High Court said in its order, “This court cannot direct Rahul Gandhi to study the petition or remove his alleged ignorance about Savarkar’s contribution.”

The court also informed that Savarkar’s great-grandson, Satyaki Savarkar, has filed a criminal defamation case against Rahul Gandhi in a special MP/MLA court in Pune, which is still pending. The court dismissed Phadnis’ petition and allowed him to raise his complaint at the appropriate forum.
While arguing for himself, Phadnis argued in the court that the Leader of Opposition (LOP) Rahul Gandhi cannot make such comments against Savarkar. He said, “In our democracy, the LOP can become the Prime Minister tomorrow. In such a situation, Rahul Gandhi should not misuse his power. He is confusing young minds. The LOP is more trusted by the younger generation than the prime minister.
In response, the court orally said, “We do not know whether he will become the Prime Minister or not. You know this.” The court made it clear that it would not accept the relief sought in the petition. However, the Supreme Court had expressed displeasure over Rahul Gandhi’s comments on Savarkar in another case in April and warned that such comments would be taken “suo motu” in the future.
