Unscrupulous people should be prevented from encroaching the public land under the guise of shrines: Delhi HC.

A bench of Justice Pratiba M Singh of the Delhi High Court asked the Delhi Development Authority (DDA) to prevent unscrupulous people from encroaching on public land under the guise of shrines.

The bench expressed serious concern over encroachment on public lands, saying that a large number of cases have come to the fore that the right to government land is claimed in the guise of shrines.

The efforts of such people should be discouraged. It is the responsibility of the authorities to ensure that the shrines are not built by encroaching on public land.

The bench, while making the above remarks, rejected the demand to permanently ban the DDA from demolishing the four temples at Patel Nagar.

The bench said that the land under consideration is public land and the plaintiff is not entitled to any relief.

The bench also imposed a fine of one lakh rupees on the petitioner and directed to submit it in favor of the Delhi High Court Legal Aid Society.

The petitioner claimed that he was a disciple of Swami Onkara Nanda, who was managing and operating the four temples.

The plaintiff had said that the temples are built in the year 1960 and have been in possession since the death of Swami Onkara Nanda in 1982.

At the same time, the DDA claimed that the entire land belonged to the government and the possession of the plaintiff is illegal.

It was argued that the plaintiff had no rights over the land and this land was given to the DDA in 1982 for the rehabilitation of the Kathpuli colony.
