Supreme Court Granted Interim Bail To Munawwar Farooqui

Supreme Court granted interim bail to comedian Munawwar Farooqui, a notice issued to the Madhya Pradesh government.

The Supreme Court has granted interim bail to Comedian Munawar Farooqui in a case registered in Indore on charges of hurting religious sentiments.

A bench headed by Justice RF Nariman has issued a notice to the Madhya Pradesh government on his petition. The High Court’s order denying him bail in the case was challenged in this petition.

The court has also stayed the production warrant issued against him in the Uttar Pradesh case in the same case.

The Supreme Court also issued notices to the governments of Maharashtra, Uttar Pradesh, Delhi. During the hearing, the bench stated that Section 41 CRPC (arrest without warrant) procedure was not followed during the arrest.

Farooqui’s lawyer Saurabh Kripal told the bench that it was a case of harassment. Farooqui filed a writ petition before the Supreme Court seeking bail, cancellation of FIR, and transfer of cases filed in different states at one place.

Apart from this, an appeal was filed against the order of the High Court. He has made the governments of Madhya Pradesh, Uttar Pradesh, Maharashtra, and Delhi parties in the case.

Farooqui and four others were arrested on January 1 following a complaint by a BJP MLA’s son.

It is alleged that he made objectionable remarks about Hindu gods and Union Home Minister Amit Shah during a comedy show at a cafe in Indore on New Year’s Day.

Another person was later arrested. The High Court, in its order dated January 28, refused to grant bail, stating that it is a constitutional duty to ‘promote goodwill’.

He is in judicial custody and lodged in Indore Central Jail. His bail plea was rejected by the magistrate court and the sessions court. He then moved to the High Court. There also he was not relieved. He then reached the Supreme Court.
