Supreme Court granted Bail to students arrested in Kerala over links with Naxalites.
The Supreme Court on Thursday granted bail to two students arrested by the National Investigation Agency (NIA) under the Unlawful Activities Prevention Act (UAPA) in November 2019 for their links with Maoists.
The Court observed that mere association with a terrorist organization is not sufficient ground to use the stringent provisions of the Act.
A bench of Justices Ajay Rastogi and AS Oka said that the accused may have been attracted to the CPI (Maoist) organization because of their young age.
The bench granted relief to Tawaha Faisal and Allan Shoaib, who was arrested on November 1, 2019.
The bench said, “Association with only one terrorist organization is not sufficient ground to invoke Section 38 (offense relating to membership of terrorist organization) and mere support to a terrorist organization, Section 39 (offense of providing support to the terrorist organization).
The aim of the relationship and support should be to increase the activity of the terrorist organization.
Faisal and Shoaib are students of Journalism and Law respectively. He was a member of the branch committee of the Communist Party of India-Marxist.
He was arrested by Kozhikode on November 2, 2019. He was expelled from the party by the CPI(M) for his links with the Naxalites.

It is called the highest honor of Indian cinema. In the year 2018, this award was given to actor Amitabh Bachchan.
Rajinikanth has also proved his mettle in many Bollywood films like ‘Hum’, ‘Terror Hi Terror’, ‘Chalbaaz’, ‘Andha Kanoon’, ‘Bhagwan Dada’.
Just a day earlier on Wednesday, he met President Ram Nath Kovind and Prime Minister Narendra Modi in Delhi.
