Inter-Caste Marriage: Supreme Court provides protection to men in the case of inter-caste marriage.

The Supreme Court on Wednesday granted protection from arrest to a man accused of kidnapping a woman. The woman had married the accused against the wishes of her parents.

Justice Ajay Rastogi and Justice Abhay S. Oka said that the petition filed by the accused person for pre-arrest bail is pending in the Calcutta High Court since April 2021 and despite his best efforts, the petition has not been heard.

The bench said that ordinarily if a petition for pre-arrest bail is pending in the High Court, there is no opportunity for this court to interfere in the petition under Article 32 of the Constitution.

The bench said, “But in view of the facts brought to our notice, the petitioner’s number one and two have got married and the documentary evidence thereof is on record.”

Keeping this in view, he is of the opinion that the individual needs to be addressed by this Court at this stage.

“Accordingly, we direct that petitioner number two (male) shall not be arrested during the period of three months in respect of the FIR registered under section 365 of the IPC,” the bench said.

We request the High Court to consider the request for an early hearing on the application for pre-arrest bail. The top court was hearing a joint petition filed by a woman and her husband.

It was said that both of them are adults and they got married on December 8, 2020. It is an inter-caste marriage, so it is not acceptable to the parents.

The report of the committee appointed by the Supreme Court is 100% in favor of farmers: Anil J.

Amid opposition to three new laws brought to reform the agriculture sector, a key member of the Supreme Court-appointed committee on Wednesday said its report was 100 percent in favor of farmers.

The Supreme Court should hear the matter at the earliest.

The committee member agreed that the government and the Supreme Court will have to consider the law and order situations that may arise after the release of the report.

For this, they will need time, but they cannot and should not bypass it.
