Central Government Got A Shock, Supreme Court Reduced The Tenure of ED Director

Central government got a shock, Supreme Court reduced the tenure of ED Director Sanjay Mishra, saying illegal.

The Central Government has received a setback from the Supreme Court in the matter of the extension of the tenure of Sanjay Mishra, Director of Enforcement Directorate (ED).

The Supreme Court has curtailed the tenure of ED director Sanjay Mishra as director. Now the term of Sanjay Mishra will be till 31st July. Previously, Sanjay Mishra will retire on November 18.

The central government extended his term for the third time. The Supreme Court told the Central Government that you have enough time till July 31 to appoint a new director.

However, the Supreme Court upheld the constitutional validity of the amendments made to the CVC and DSPE Act.

Through these amendments, the tenure of CBI and ED director can be extended up to 5 years.

Judge BR Gavai, Judge Vikram Nath, and Judge Sanjay Karol said that in view of the peer review undertaken by the Financial Action Task Force (FATF) this year and to make the transition smooth, share, SK Mishra’s term will last until 31st July.

While according to the notification issued by the government, SK Mishra, a 1984-batch IRS officer, was to remain in office till November 18, 2023.

Sanjay Mishra was appointed as ED director on November 19, 2018, for two years. But his tenure has been extended after this.

Hearing petitions challenging the third extension to ED Director Sanjay Mishra’s tenure, the Supreme Court had in May said it may revisit its 2021 verdict that a retired officer’s tenure can be extended only in exceptional circumstances.

The Supreme Court, on December 12 of last year, sought feedback from the Center and others on the third extension challenge plea granted to Mishra.

The central government had given Sanjay Kumar Mishra an extension of one year in November last year, a day before he was to retire.

This was the third extension in the tenure of Mishra, who was to hold the post till November 18, 2023. His total tenure as ED chief was five years.
