Big relief to former minister and Akali leader Bikram Singh Majithia from Supreme Court, ban on arrest till January 31.
The Supreme Court has given a big relief to senior Akali leader and former minister Bikram Singh Majithia, who is involved in the NDPS case.
The Supreme Court has stayed the arrest of Majithia in the case till January 31. The Supreme Court has asked the Punjab government not to take any coercive steps till Monday.
On January 31, the Supreme Court will hear Majithia’s anticipatory bail plea.
Earlier, the Punjab and Haryana High Court had rejected Majithia’s plea for anticipatory bail. After which Majithia has filed a petition in the Supreme Court for anticipatory bail.
The sword of arrest hung on Majithia after the Punjab and Haryana High Court rejected his anticipatory bail plea.
The High Court, while dismissing the petition, said that there are serious allegations against the petitioner, in such a situation, custodial interrogation is necessary.
On Monday, before the bench of Justice Lisa Gill, Majithia’s anticipatory bail plea was debated between the two sides for nearly three hours.
The HC, after a long debate and hearing both the sides, while keeping its decision on this petition at one o’clock, said that the decision on this petition will be pronounced at four o’clock in the evening.
At 4 pm, the High Court, while giving its verdict rejecting the anticipatory bail of Majithia, said that custodial interrogation is necessary in the case, in which case anticipatory bail cannot be granted.
On behalf of the Punjab government, it was said that Majithia has joined the investigation of this case but he is not cooperating in the investigation.
After which the court dismissed Majithia’s petition. On this, it was requested by Cheema that she should be given interim protection of three days to file an appeal in the Supreme Court.
In this case, Majithia had earlier filed a petition in the district court of Mohali seeking anticipatory bail, which was rejected. Majithia had sought anticipatory bail by filing a petition in the High Court.
While granting interim bail to Majithia on January 5, the High Court had ordered him to join the investigation.
The Punjab government had told the High Court that even though Majithia had joined the investigation, he was not cooperating in the investigation.
The reply was filed on behalf of Bikram Singh Majithia alleging that the purpose of seeking his custody was an impartial one. Not for investigation but for humiliation and custodial torture.
Majithia, in his reply, said excerpts from statements made by PPCC President Navjot Singh Sidhu show that the sole purpose of registering a case is politics.
Furthermore, the investigation conducted so far is clearly opaque, partisan, politically motivated, and unprofessional.
By filing an application in the High Court on behalf of Majithia, additional facts were presented along with the records of the incidents, and documents regarding joining the investigation.
Majithia has also put on record the order issued by the then DGP Siddharth Chattopadhyay on December 27, 2021, exercising his special powers to promote SI Prince Preet to the rank of Inspector.
This particular SI is the son of AIG Balraj Singh, who heads the SIT set up by Siddharth Chattopadhyay to investigate the present case.
Balraj Singh was thus rewarded by Chattopadhyay for conducting the investigation in the most unfair and partisan manner.
It has also been said by the SAD leader that the statement of Jagdish Singh alias Bhola, recorded under Section 161 of CrPC, does not reveal that he ever had any conversation with Majithia.
It is a fact that Jagdish Singh Bhola is a condemnable and hardened criminal. Most of his statements under Section 161 CrPC state that he was falsely implicated in the case.
Does the Punjab government accept his plea which is being relied upon? This is a very unfortunate situation.
