The Madras High Court has directed the withdrawal of salaries of two women police officers for not implementing a court order on non-bailable warrants against two persons in a domestic violence case.
Justice P. Velmurugan’s recent order comes on a petition filed by the petitioner against his father-in-law, seeking a direction to the first respondent police to execute the non-bailable warrant issued by the local court.
Though both had filed a petition in the High Court seeking quashing of the non-bailable warrant, the court ordered the police to execute the warrant and file a compliance report.
The court observed that both the women officers were posted as Inspectors in the Respondent Police Station at the relevant time and it is clear that both had not taken any effective step to comply with the order of the Court.
Being public servants, both did not discharge their duties satisfactorily.
Being public servants, both are getting salaries from public money and they did not give any valid reason for not obeying the order of the court. Hence they are not entitled to get a salary for that period.
Therefore, the Commissioner of Police, Chennai is ordered to take departmental action against both the officers and to withdraw the salary received by them during their posting in the police station.
This amount will be sent back to the Tamil Nadu government and an action taken report will be filed in this court before February 2022.
