Terror Funding Case: The Delhi High Court has asked JKLF chief Yasin Malik to respond to the NIA’s appeal seeking the death penalty in the terror funding case. The next hearing is set for November 10 via video conferencing due to security reasons.

The Delhi High Court heard the NIA’s petition seeking the death penalty for Yasin Malik in the terror funding case. The court asked Yasin Malik to respond and fixed the next hearing on November 10. For security reasons, Yasin Malik has been directed to produce his production through video conferencing. The NIA has appealed against the trial court’s life imprisonment verdict.

The Delhi High Court has sought a reply from Jammu and Kashmir Liberation Front (JKLF) chief Yaseen Malik, who is serving a life sentence in the terror funding case, on the National Investigation Agency (NIA)’s appeal petition seeking the death penalty.

A bench of Justice Vivek Chaudhary and Justice Shalinder Kaur gave Yasin Malik four weeks to file a reply and fixed the next hearing on November 10.

Malik had earlier expressed his desire to appear in person in the High Court to present his arguments and refused to appoint an advocate. For security reasons, the jail administration had sought permission for her video conferencing appearance, which the court accepted. The court directed that Yasin Malik be produced from Tihar jail on November 10 through video conferencing. Earlier, on August 9, 202, Yasin was also ordered to be produced by video conferencing instead of being produced physically for security reasons. However, he was not even brought in by video conferencing in the hearing on Monday and did not file his reply.

Terror Funding Case: NIA’s argument

The NIA appealed to the High Court against the trial court’s decision to award life imprisonment, arguing that life imprisonment cannot be awarded in cases of serious terror offenses merely because the accused has pleaded guilty. The agency says if the death penalty is not imposed in such cases, it will undermine the sentencing policy and give terrorists an escape route.

The trial court had, on May 24, 2022, convicted Yaseen Malik under the Unlawful Activities (Prevention) Act (UAPA) and IPC and sentenced him to life imprisonment. He had considered that Malik’s activities struck at the core of the concept of India and were aimed at forcibly separating Jammu and Kashmir from India.
