Supreme Court Granted Bail To Gagan Singh

Supreme Court granted bail to Gagan Singh, life imprisonment for 19 years in jail for murder.

The Supreme Court has granted bail to inmate Gagan Singh, who has been imprisoned for 19 years, who is serving life imprisonment for murder.

Simultaneously, the court directed the Uttar Pradesh government to consider the premature release of the prisoner. The court has asked the state government to complete the process in three months and file a compliance report in the court.

These orders were given by a bench of Justices AM Khanwilkar and Dinesh Maheshwari during the hearing of the petition demanding the premature release of Gagan Singh.

Earlier, advocate Jitendra Singh, appearing for the prisoner, told the court that according to the arrangement laid down by the Supreme Court in the Maru Ram case.

The state government should consider the premature release of the prisoner after completion of 14 years sentence.

Gagan has been serving a sentence for the past 19 years but the government did not order his premature release.

The state government turned down the plea without giving any concrete reason, which is not fair.

The Supreme Court in its order after hearing the arguments stated that the petitioner Gagan Singh may be eligible for premature release as per the provisions of UP Prisoners Release on Probation Act 1938 and CRPC.

Along with this, the court ordered that in the meantime Gagan Singh would be released on bail. The terms of the bail shall be to the satisfaction of the trial court concerned.

Gagan Singh Adarsh Jail is currently closed in Lucknow. He was sentenced to death by the trial court for murder, but the High Court commuted the death sentence to life imprisonment. The petition said that Gagan’s conduct in the jail was good.
