Supreme Court approves dismissal of constable of CISF, know what is the matter.
The Supreme Court upheld the dismissal of a constable of the Central Industrial Security Force (CISF), observing that honesty, discipline, and mutual trust are “paramount” given the nature of the force.
This constable was found sleeping while on patrol duty. He allegedly attacked her when she was scolded by an officer for this.
A division bench of Justices Sanjiv Khanna and Bela M Trivedi observed that when the charge of misconduct is proved, the quantum of punishment depends on the discretion of the adjudicating authority. It comes under its jurisdiction.
Supreme Court approves dismissal of constable of CISF: The apex court gave this verdict on the appeal of the Center and others.
The appellants had challenged the January 2018 decision of the Orissa High Court division bench. The High Court had upheld the decision of the single bench set aside the sentence of dismissal.
The Supreme Court held that courts cannot interfere on the merits of the quantum of sentence awarded unless the exercise of discretion in awarding the sentence is contrary to the feeling that it is absolutely disproportionate.
The Supreme Court bench said that this person is a constable of the Central Industrial Security Force (CISF).
It is a special police force responsible for providing security to the premises of establishments of strategic importance such as the Department of Space, Department of Atomic Energy, and establishments that are fundamental to the Indian economy.
The court, in its judgment on February 24, said that honesty, discipline, and mutual trust are paramount in view of the nature of this appellant’s force.
It said that no leniency or leeway can be given when the matter relates to violence and assault on the officer conducting the investigation and reprimand.
