Saji Cheriyan will again take oath as minister, CM had recommended to the Governor.

Saji Cheriyan, leader of the Communist Party of India-Marxist, who was sacked from the Kerala state cabinet, will take oath as a minister again.

CPIM leader Saji Cherian will be sworn in as a minister in the Kerala cabinet on January 4 at 4 pm.

Kerala Governor Arif Mohammed Khan on Tuesday approved Chief Minister Pinarayi Vijayan’s recommendation to reinstate leader Saji Cheriyan as a minister.

Sources have said that Cherian will be administered the oath of office at 4 pm on Wednesday.

What was the whole matter?

The leader of the Communist Party of India-Marxist had allegedly made remarks against the Constitution during a speech in the Pathanamthitta district in July last year.

He was embroiled in controversy after his controversial remarks. Opposition parties had targeted him fiercely.

Following this Saji Cheriyan resigned from the state cabinet over a criminal case being registered against him in connection with his controversial statement.

Saji Cherian in his controversial statement said that the country’s constitution ignores exploitation and it is written in such a way that it helps to loot the people of the country.

Violation of Section 9 of the Representation of the People Act, 1951.

Petitions were filed to get Saji Cherian to resign from the post of the state cabinet. The petitions said that Cherian’s remarks violated Section 9 of the Representation of the People Act, 1951.

Therefore they should be disqualified. Under this section, it was said that while in office under the Government of India or the Government of any State, he shall be dismissed on the charge of corruption or disloyalty to the State.

In this regard, he will be considered disqualified for a period of five years.

The petitions also alleged that Cherian violated Articles 173(A) and 188 of the Constitution and a case was also registered under the Prevention of Insults to National Honor Act 1971 in connection with his controversial speech.

CPIM decided to bring him back.

However, the ruling CPI(M) decided to bring him back to the cabinet on December 30, 2022.

After which he sent a letter to the Governor the next day seeking the facility of administering the oath of office to the MLA on January 4.

Arif Mohammad Khan, who returned to the state on Monday, had said that he needed to see the papers related to Cherian’s reinstatement in the cabinet as it was not an ordinary matter.
