Relief to HD Deve Gowda in a defamation case, Supreme Court refuses to interfere with the order of the Karnataka High Court.

In a relief to former Prime Minister HD Deve Gowda, the Supreme Court on Friday refused to interfere with an order of the Karnataka High Court.

The High Court had stayed the order of the trial court to pay damages of Rs 2 crore in a defamation case filed against Deve Gowda by a construction company.

A bench of Justices DY Chandrachud and Hima Kohli, however, observed that their reputation, the value of shares, and investments are affected by the statements made by influential people against the companies.

In the defamation case, the trial court, in its order dated June 17, 2021, had ordered damages of Rs 2 crore to Nandi Infrastructure Corridor Enterprises (NICE) in respect of a TV interview given to Deve Gowda 10 years ago by him.

The apex court, while hearing the appeal of NICE, said that the High Court in its order dated February 17, 2022, had directed Deve Gowda not to make any statement that tarnishes the reputation of the appellant.

In violation of this, the company can again go to the High Court.

Petition to donate liver to father.

The Supreme Court has sought a response from the Uttar Pradesh government by Monday on a plea by a minor boy who is ready to donate his liver to his seriously ill father.

Considering the urgency of the matter, a bench headed by Chief Justice UU Lalit issued notice to the state government on Friday.

The minor’s counsel told the bench that his father’s condition was critical and organ donation was the only way to save his life.

The bench took note of the fact that as per the law in this context, the donor should be a major.

At the same time, its attention has also been drawn to the representation of September 6 sent to the Health Secretary of Uttar Pradesh, seeking permission to allow the son to donate his liver to the father.

The top court also said that a responsible officer of the health department of Uttar Pradesh would be present during the hearing on Monday.

Also directed the petitioner that he can go to the hospital and get a preliminary test on whether he can be a donor and whether his organ donation will be possible.
