Punjab Govt Objected To Demand Of Transfer Of Mukhtar Ansari

Punjab govt objected to the demand of transfer of Mukhtar Ansari from Punjab in Supreme Court, know what was said by the Punjab Lawyer.

Punjab govt and gangster-turned-politician Mukhtar Ansari told the Supreme Court on Thursday that Yogi Adityanath’s government had no fundamental right to demand the transfer of him from Rupnagar jail to Banda jail in Uttar Pradesh.

The UP government approached the Supreme Court and directed the Punjab government and the Rupnagar jail administration to direct the custody of Mau MLA Ansari to the district jail Banda at the earliest.

Justices Ashok Bhushan and Justice R.S. The Reddy Bench said that it would give its verdict on the petition of the Uttar Pradesh government and Ansari.

Ansari has demanded a transfer of cases against him outside Uttar Pradesh. Solicitor General Tushar Mehta, appearing for the Uttar Pradesh government during the hearing.

He cited the jail rules and said that even though the state does not have fundamental rights, it can support the issue and the rights of the victims and the role of the victim.

Tushar Mehta said that to say that the state does not have fundamental rights is wrong because the state can always discharge the role of the victim and society.

Mehta said that Ansari violated jail rules and the rights of the victims and the state cannot be ignored and the accused cannot be allowed to obstruct a fair trial.

Tushar Mehta said that under Article 142, the court can order transfer from Punjab Jail to Uttar Pradesh Jail as there are 14 to 15 cases against Mukhtar in the final stage.

He said that if video conferencing was the most equitable way of hearing, then the trial of the man could be done even if the person is in Britain.

Senior advocate Mukul Rohatgi, appearing on behalf of Ansari, said that he was being targeted due to being associated with a party of the opposition.

Rohatgi said Ansari is appearing in different courts through video conferences and ‘nonsense arguments’ is being made that the hearing is being obstructed.

Rohatgi said that I request to transfer cases outside Uttar Pradesh. Due to political vendetta in the state, he can be shifted to Delhi.

On the other hand, senior advocate Dushyant Dave, appearing for the Punjab government, said that a criminal hearing has been going on against Ansari in Uttar Pradesh for the last 14-15 years.

The writ petition of Uttar Pradesh is not hearsay and it should be dismissed.

It is noteworthy that Ansari is lodged in Rupnagar District Jail, Punjab since January 2019 in an alleged case of extortion. He is accused in several serious criminal cases in Uttar Pradesh.
