The Delhi High Court orally observed that the speech made by Khalid in Maharashtra’s Amravati was objectionable and prima facie was not acceptable.

A bench of Justice Siddharth Mridul and Justice Rajneesh Bhatnagar said that the speech is objectionable and obnoxious.

Do you not think that these expressions used are derogatory to the people, the bench asked. It is almost as if the freedom struggle of India was fought by only one community.

The bench raised the question of whether Gandhiji or Shaheed Bhagat Singhji had ever used this language?

We have no problem in allowing freedom of expression, but what are you saying?

The bench made the remarks when senior advocate Tridip Paes, appearing for Khalid, read out a part of Khalid’s speech before the court.

When the bench asked what was the charge against Khalid. In response, senior advocate Tridip Paes, appearing for Khalid, argued that Khalid was accused of conspiracy but he was not present in the city.

Prima facie Umar Khalid’s objectionable speech is not acceptable: Speech made is not acceptable.

While making the above oral observations, the bench issued notice to the Delhi Police on Khalid’s bail plea and directed the Delhi police to file its reply in three days.

The next hearing on the petition will be on April 27. Umar Khalid, who has been in jail for 19 months, has challenged the Karkardooma Court’s decision to deny bail on March 24 in the Delhi High Court.

Umar Khalid was arrested on 13 September 2020 in the North-East Delhi riots case in February-2020 and is in custody since then.
