Petition Challenging WB Assembly Elections Dates,Dismissed

Petition challenging the EC over the dates, dismissed in the Supreme Court: West Bengal  Assembly Elections.

A petition objecting to the date fixed by the Election Commission for the West Bengal assembly elections was dismissed in the Supreme Court on Monday.

The dates were announced by the Commission regarding elections in 8 phases in West Bengal. This decision of the Commission was sought to have stayed.

Apart from the Election Commission, Union Home Minister Amit Shah, who recently joined BJP, Shubhendu Adhikari and CBI have also been made parties in this petition.

Petition challenging the EC over the dates: The case was heard by a bench of Chief Justices SA Bobde, Justices AS Bopanna and V Ramasubramaniam.

Election dates have been announced in four states and one union territory of the country. Assembly elections are going to be held in West Bengal in eight phases.

A Public Interest Litigation was filed against this by Advocate Manohar Lal Sharma, which was heard in the Supreme Court today.

The petition said that there are elections in four more states along with West Bengal, but the voting schedule there is not so elaborate.

The Election Commission has kept the election period in West Bengal longer than the rest of the states without any justified reason.

The petition has also raised objection over slogans of Jai Shri Ram during an election campaign in the state. According to this, raising slogans like this is to ask for votes on religious grounds.

The Supreme Court has given its verdict against it. The petitioner has also alleged the misuse of the CBI during the election for political reasons.

Explain that under Article 324 of the Constitution, the decision on the election process is under the Election Commission.

The commission is empowered to decide, monitor, and control the election process. Under this, the Commission assesses the security and other conditions in an area and takes other decisions, including the election period.
