Despite torture and psychological pressure, Upadhyay maintains his innocence, citing clean reports from narco-analysis and polygraph tests.

Ramesh Upadhyay, accused in the 2008 Malegaon bomb blast case, told the special NIA court that he was implicated in proving the ‘theory of Hindu terrorism’ during the reign of the then UPA government.
He claimed that this work was done through Maharashtra Anti-Terrorist Squad (ATS).
In the special NIA court on Tuesday, Ramesh Upadhyay, accused in a 16-year-old case, claimed innocence and said that he had nothing to do with the bomb blast.
The anti-terrorism squad of Mumbai has implicated me in this case. Because of the UPA governments at the Center and in the state, there was tremendous pressure on Maharashtra ATS to prove the ‘theory of Hindu terrorism’.
He said that the ATS not only tortured him physically but also subjected him to mental torture by keeping him in illegal custody.
Upadhyay alleged that he was threatened that his wife would be paraded naked. His unmarried daughter would be raped and his son’s jaw would be broken.
My landlord was threatened and psychologically pressured into refusing to rent his bungalow to a terrorist.
Upadhyay said that when I refused to admit to any crime or agree to implicate anyone else in it, I was arrested on the night of Diwali and produced in the Nashik Magistrate Court.
He also showed the magistrate the marks of torture on his body and agreed to cooperate in the investigation. Also gave consent for narco-analysis to prove his innocence.
Polygraph tests and narco-analysis proved my innocence.
Despite being given a clean chit in these reports, this report was not presented in court. Even in the chargesheet and testimonies, there was no evidence against me.
This is the matter.
It is noteworthy that on September 29, 2008, four people were killed and more than a hundred people were injured in a bomb blast on a motorcycle near a mosque in Malegaon.
The investigation of the case has been handed over from Maharashtra ATS to NIA.
