Maharashtra floor test: Mumbai Police on alert, Section 144 imposed, notice being sent to Shiv Sena workers.
Mumbai Police has been put on alert in view of the floor test to be held in Maharashtra on Thursday. Police have also started giving notices to Shiv Sena workers.
According to the notice, Section 144 is in force in the whole of Mumbai, and gathering of more than 5 people is prohibited, so if law and order break down, strict action will be taken against them.
Maharashtra Governor Bhagat Singh Koshyari has asked the secretary of the Maharashtra Legislative Assembly to conduct a floor test of the Uddhav Thackeray-led government on Thursday at 11 am.
According to a news agency, Mumbai Police said, “Mumbai Police is on alert amid reports of Eknath Shinde group reaching Mumbai on Thursday in view of floor test.
Notices have been sent to NCP, Shiv Sena, Congress, BJP, and SP leaders not to make provocative statements or issue objectionable posts. Strict action if the situation worsens.”
Governor’s direction to conduct floor test unconstitutional: Shiv Sena.
Meanwhile, Shiv Sena Chief Whip Sunil Prabhu on Wednesday alleged in the Supreme Court that the Maharashtra Governor’s direction to the Uddhav Thackeray-led Maha Vikas Aghadi (MVA) government to hold the trust vote in the Assembly on Thursday was “malicious, unconstitutional and illegal”.
Justice Surya Kant and Justice J. B. The petition was mentioned before the vacation bench of Pardiwala challenging the direction of the Governor.
Shiv Sena said, ‘Violation of Article 14.’
It has been argued in the petition that Governor Bhagat Singh Koshyari, vide his letter dated June 28, 2022, decided to conduct a floor test in complete disregard of the fact that this Court was considering the issue of disqualification proceedings of MLAs.
The petition also argued, “Such undue haste is clearly arbitrary and violative of Article 14.”
Request to quash the governor’s direction in the petition.
In the petition, a request has been made to quash the instructions sent by the Governor to the Chief Minister as well as the Secretary of the Legislative Assembly.
Shiv Sena’s petition said that this court is looking into the legality of the disqualification proceedings of the MLAs and the matter is to be heard on July 11, 2022.
The issue of disqualification is directly related to the issue of the strength test.
Prabhu argued in his petition that such directions should not have been issued without the consultation and advice of the Chief Minister-led Council of Ministers.
