The Kerala High Court on Friday said that though marital rape is not punishable in India, divorce can certainly be claimed on the basis of it.

The family court had allowed divorce on the ground of marital cruelty. In this case, there were serious allegations of sexual harassment against the husband.

Delivering the verdict, a bench of two judges, Justice Mohd Mushtaq and Justice Kausar Edappagath, observed that marriage and divorce need to be brought under secular law.

The bench said that this is the need of the hour. It was also said on behalf of the court that now the time has come to improve the marriage law.

The framework of divorce law should be aimed at helping individuals make decisions on their cases.

This framework should promote a platform at different levels so that individuals can exercise free choice. The High Court upheld the decision of the Family Court, rejecting the application of the husband.
