Kerala High Court allows minor rape victim to undergo abortion, with this condition.
The Kerala High Court has allowed a minor rape victim to undergo an abortion. The victim is 28 weeks pregnant.
The High Court allowed the victim to undergo a medical abortion (MTP) on the basis of a report from the medical board.
The medical board examined the victim and said that the pain caused by the continuation of the pregnancy could cause mental trauma to the 14-year-old.
This medical board was constituted following the court’s direction on August 12.
Considering the suggestion of the board, the court allowed the MTP and directed the petitioner (mother of the victim) to file an affidavit.
In which she should give the right to the medical team to perform ‘surgery’ on their (victim’s mother’s) responsibility.
The court also said that if the fetus is alive after this ‘surgery’, the hospital should ensure that it is saved through advanced medical treatment so that it can develop into a healthy baby.
Kerala High Court allows minor rape victim to undergo abortion: The court further said that if the petitioner is not ready to take responsibility for the child.
The state and its agencies will take full responsibility keeping in view the best interests of the child and the statutory provisions of the Juvenile Justice (Care and Protection of Children) Act 2015.
The state will also provide medical help and facilities to the child.

Kerala: Man jailed for 30 years for raping minor stepdaughter.
A speedy court in Kerala on Wednesday sentenced a man to a total of 30 years in prison for several offenses under the Protection of Child Sexual Offenses Act (POCSO) for raping a minor step-daughter.
However, the convict will serve only 10 years in jail as this is the maximum punishment awarded by the court under the POCSO Act for each of the various offenses of sexual assault on a minor below the age of 12 years by a relative or confidante.
Special Judge of the Accelerated Court T.G. The order passed by Varghese was confirmed by Special Public Prosecutor (SPP) S. s. Sanesh did it.
SPP Sanesh said that in 2018 in the Idukki district, the 32-year-old accused had raped his minor step-daughter at home in the absence of her mother.
The SPP said that the court convicted the accused on the basis of the statement of the victim and her younger sister who witnessed the incident.
