The SC is hearing the petitions filed against the Bombay High Court’s decision on the Posco law today.

Recently, the Nagpur bench of the Bombay High Court, while ruling in the case related to the Posco Act, said that touching a minor victim without skin-to-skin touch does not come under the category of a sexual offense.

It is not sexual harassment under the Poxo Act. The court had ordered the release of a man sentenced to three years. The Supreme Court has already stayed the decision. The court stayed the decision on 27 January.

The Supreme Court had issued notice to the accused and the Government of Maharashtra to file a reply within two weeks and Attorney General KK Venugopal had allowed an appeal against the decision.

The Attorney General had termed the Bombay High Court’s decision as unprecedented and said that it would lead to a wrong cause.

The bench, headed by Chief Justice SA Bobde, will hear the petitions filed, including the National Commission for Women, in the case.

What was the Bombay High Court ruling.

The Bombay High Court, in a January 19 judgment, held that a case under Section 8 of the Protection of Children from Sexual Offenses (Poxo) Act was not made against the accused as he had direct physical contact with the victim ie Skin to Skin ) Did not contact.

The accused did not remove the clothes, so it could not be considered as sexual misconduct under Posco. The High Court did not consider the 12-year-old girl’s breastplate over her clothes to be sexually abused by the Posco law.
