Dr. Kafeel Khan’s troubles will increase again, UP government challenges the High Court’s decision in the Supreme Court.

Dr. Kafeel Khan, lecturer of BRD Medical College, Gorakhpur, may face difficulties again.

The Yogi government of Uttar Pradesh has challenged the Allahabad High Court’s decision to cancel the custody of Dr. Kafeel Khan under the National Security Act (Rasuka) in the Supreme Court.

The state government says that Dr. Kafeel Khan has a history of committing crimes.

This is the reason disciplinary action has been taken against him. He was suspended from his job. An FIR was lodged against him and he was booked up to Rasuka.

The Yogi government of Uttar Pradesh had arrested Dr Kafeel Khan under the NSA in a provocative statement case against the Citizenship Amendment Act (CAA), National Population Register (NPR), National Register of Citizens (NRC).

In this case, he got relief from the Allahabad High Court on September 1, 2020.

The High Court had said in its order that under the NSA it is illegal to detain Dr. Kafeel and thereafter extend the period of detention.

Dr. Kafeel Khan was released from Mathura jail after the High Court’s decision. Now the UP government has reached the Supreme Court against the High Court’s decision.

UP government said- tried to spoil law and order: Yogi government has said in the petition that even after informing Dr. Kafeel that Section-144 is applicable around Aligarh Muslim University and the High Court has also given 100 meters of AMU.

There is a ban on picketing and rally in the circle, they went there and addressed the students and gave provocative speeches. He tried to spoil law and order.

The result of the same inflammatory speech was that on December 13, 2019, about 10 thousand students of AMU started marching towards Aligarh city.

If the police did not stop explaining violent students, there was a possibility of communal harmony deteriorating.

The state government says that the decision of the High Court is not correct.

Here’s the whole issue: Dr. Kafeel Khan, Yogendra Yadav also participated in the protests against the Citizenship Amendment Act on December 12, 2019 at Aligarh Muslim University.

It is alleged that Dr. Kafeel Khan gave a provocative speech there. An FIR was lodged at the Civil Lines Police Station in Aligarh on this.

On 29 January 2020, he was arrested and sent to Mathura jail.

On 10 February, CJM Aligarh approved the bail application of Dr. Kafeel but, on 13 February, the District Magistrate Aligarh ordered for rectification under Rasuka.

Dr. Kafeel’s mother challenged the validity of Rasuka in the court, after which he got relief from the High Court.

Dr. Kafeel has gone to jail twice: Dr. Kafeel Khan has been sent to jail twice.

Dozens of children died on 10 and 11 August 2017 due to obstruction of oxygen supply at Baba Raghavdas Hospital Gorakhpur.

On this, Dr. Kafeel Khan was suspended and sent to jail on September 2, 2017, later he was granted bail.

He was then released on the orders of the High Court after being jailed for eight months for making inflammatory speeches in AMU.
