Calcutta High Court Cancels Anticipatory Bail Of 13 Accused

Calcutta High Court cancels anticipatory bail of 13 accused, CBI is investigating: West Bengal Election Violence.

The Calcutta High Court on Monday canceled the anticipatory bail of 13 accused in the murder case of Haran Adhikari during the violence after the assembly elections in West Bengal last year.

Following the order of the High Court, the Central Bureau of Investigation (CBI) took over the investigation on September 1, 2021.

A CBI spokesperson said, “It is alleged that on the evening of May 2, 2021, at 8 pm, the said accused and others beat up the deceased Haran Adhikari and other persons with bricks, sticks, shovels, and axes in front of the house of one of the accused in the case.”

Haran Adhikari, a member of the Bharatiya Janata Party (BJP), who was seriously injured in the beating, later died during treatment.

CBI has booked 17 accused including Qurban, Yunus, Humayun, Rahibul Mulla, Usman Mulla, Maiuddin Mulla, Momrez Mulla, Akhtar Mulla, Reshma Mulla, Supriya Bibi, Sirajul, Safikul Qazi, and Dud Ali Mulla

The supplementary charge sheet was filed in the court of Additional Chief Judicial Magistrate, Baruipur.

After this, the District and Sessions Judge of Alipore in South 24 Parganas granted anticipatory bail to all the accused.

Calcutta High Court cancels anticipatory bail: The court said, “It can be said that on the basis of material available in the case diary as on the date of the order granting anticipatory bail.

It can be said that the two injured eyewitnesses have at least two persons under section 164 of the Code of Criminal Procedure. Statements were recorded which make all the opposing parties accused.”

A bench of Justice Debangshu Basak and Justice Bibhas Ranjan Dey said, “In such circumstances, we feel that the order granting anticipatory bail is adverse.

Therefore, the order of granting anticipatory bail to all is set aside.
