Bombay High Court withdraws a comment praising Stan Swamy, NIA objected to the remark.

A division bench of the Bombay High Court headed by Justice SS Shinde has withdrawn the oral remarks made in praise of Father Stan Swamy, an accused in the Elgar Parishad case.

Stan Swamy had recently passed away from a serious illness.

Stan Swamy was admitted to this private hospital from Taloja Jail on the directions of the High Court.

Additional Solicitor General Anil Singh, appearing in the High Court on behalf of the National Investigation Agency (NIA), objected to the High Court’s remarks during the hearing.

The Bombay High Court on Monday remembered Stan Swamy, saying it admires him for the work he has done for the society, other than legal matters. It was not expected that he would die.

Bombay High Court withdraws a comment: During the hearing on Friday, Singh said a negative image is being created against the NIA and it affects the morale of the investigators.

He said Justice Shinde made this remark in an open court and it was widely reported in the media.

Meanwhile, senior advocate Mihir Desai, appearing for Swamy, requested the High Court to exercise his special powers to supervise the magisterial inquiry into the death of Stan Swamy, an accused in the Elgar Parishad-Maoist relationship case.

Stan Swamy died on July 5 while undergoing treatment at a private hospital in the city. Desai requested the High Court to allow Swamy’s aide,

Father Fraser Mascarenhas, to join the investigation into Swamy’s death in accordance with Section 176 of the Code of Criminal Procedure.

Additional Solicitor General Anil Singh, appearing for the NIA, submitted that the agency has no objection to Father Mascarenhas participating in the investigation.

So the court need not direct the magistrate to comply with the NHRC guidelines as it is part of the process. is and will be followed. The next hearing of the matter in the High Court will be on August 4.
